Exemption Application Procedures
Applications for exemptions from having to obtain a permit or a licence or from the requirement to carry out an environmental impact assessment must be addressed in writing to the Minister, via the Deputy Director: Integrated Coastal Management, 7 th Floor, Foretrust Building, Martin Hammerschlag Way, Foreshore, Cape Town, 8001. The stipulated form for an exemption application can be downloaded from the "Application Forms" page on this website. All of the requirements under regulation 20 must be complied with. It should be noted in particular that exemptions will only be granted in exceptional circumstances.
Applicants must provide the Minister with the essential information listed below. Failure to provide this information will result in the application being refused. The material information is important for the purposes of properly evaluating applications. Failure to provide this information may result in the application being refused.

Essential Information:
Applicants must -
- Demonstrate exceptional circumstances why they are seeking an exemption;
- Submit proof that no significant harm to the coastal zone will be caused;
- Submit proof that no rights of the general public to enjoy the coastal zone will be seriously affected;
- Demonstrate that the granting of the exemption will be in the public interest; or
- Alternatively, in the interests of protecting the environment..
Material information:
Applicants should -
- Provide details regarding the type of vehicle(s) intended for use;
- Describe the area of the intended use, including precise details of the boundaries of the coastal zone;
- Describe the purpose of the use;
- Set out the duration of the intended use;
- Provide the full name and address of applicant;
- State how many persons are to accompany the applicant and their respective status and purpose;
- Describe the reasonable measures that are to be taken to avoid causing harm to the environment; and
- Describe, if any harm anticipated is unavoidable, how will it be minimised and be rectified.
Applicants must note that many other persons are currently submitting permit applications and/or exemption applications. A reasonable period of time, i.e. between 45 and 60 days, should therefore be allowed for the processing of applications.
