COMPLIANCE AGREEMENT

DESCRIPTION & FOCUS AREA

The purpose of the Compliance Agreement is to provide an instrument for countries to take effective action, consistent with international law, to deter reflagging of vessels by their nationals as a means of avoiding compliance with applicable conservation and management rules for fishing activities on the high seas.

STATUS

The Compliance Agreement is an integral component of the Code of Conduct for Responsible Fisheries. It is a legally binding international instrument.

It will enter into force upon receipt of the 25 th instrument of acceptance (currently 10 states have accepted the Agreement)

Approved by Cabinet on 6 February 2002 (decision no. 34). Parliamentary submission has been prepared. Need to conduct process of public consultation (via Govt. Gazette)

IMPLICATIONS & BENEFITS FOR SOUTH AFRICA

Revision of the Marine Living Resources Act to enable effective control over South African flagged vessels and South African nationals engaged in fishing activities on the high seas.

Maintain register of vessels licensed to fish on the high seas and submit details of all such vessels to the High Seas Vessel Registration Database System (HSREG) of the FAO.
