Introduction

The Environmental Impact Assessment process is a crucial mechanism used to determine the impact of proposed projects in the construction and / or operational phase on the state of the environment. The Department of Environmental Affairs and Tourism as well as Provincial Environmental departments are responsible for EIA processes and ensuring the timely and accurate execution of EIA’s.

BACKGROUND

During 2000 DEAT and provincial authorities embarked on a process which resulted in the final draft of the new EIA Regulations. The development of the new regulations were funded by NORAD, and the Norwegian Ministry of Environment provided valuable assistance during the drafting process. The new draft EIA regulations were approved by DEAT Minister Marthinus van Schalkwyk in July 2005. The amended final draft has been launched by the Minister today 19 April 2006. These regulations will be Gazetted on 21 April 2006 and will come into effect on the 1 July 2006.
