Subdirectorate: Environmental Management Systems and Tools

Mission:

The subdirectorate aims to establish and manage the implementation of self-regulatory aspects of Integrated Environmental Management in the public and private sector. In addition the subdirectorate also aims to ensure that feedback on environmental policy implementation is supported by environmental auditing.

Objectives:

The main objective is to develop a framework on self-regulatory, co-regulatory and voluntary environmental initiatives in industry by:

  • promoting and providing information on the international ISO 14 000 standards.
  • Giving effect to Chapter 8 of the National Environmental Management Act 107 of 1998 which deals with co-operation agreements.
  • The sub-directorate is required to provide information regarding chapter 8 to organisations that wish to enter into environmental co-operation agreements (develop guidelines).
  • The sub-directorate is also required to compile information on preconditions and incentive structures for Environmental co-operation agreements.

Subdirectorate: Assessment, Monitoring and Enforcement
Mission:

To facilitate the integration of environmental impact management with all development activities. To promote the utilisation of resources by the preparation, implementation and enforcement of policy, legislation and guidelines for decision-making that will limit detrimental impacts and advance positive impacts of all developments.

Functions:
  • Develop policy, procedural regulations and guidelines.
  • Co-ordinate environmental planning in active governance.
  • Ensure cmpliance and enforcement of environmental standards.
  • Responsible for the implementation of sections 21,22 and 26 of the Environment Conservation Act (23 of 1989), regulations numbers 1182 and 1183.
  • Responsible fot the implementation of Chapters 1 and 5 of the National Environmental Management Act (107 Of 1998). NEMA incorporates principles in all Environmental Impact Assessments (EIA's) received for comments.
  • Investigate and provide all EIAs on National Level referred to the minister in terms of the EIA regulations below:

The provincial authority must refer the application to the Minister for consideration-

  • where the activity concerned has direct implications for national environmental policy or international environmental committments or relations;
  • where the environment under threat is demarcated as an area of national or international importance;
  • where the Minister and the provincial authority jointly decide that an application in respect of a specific activity should be considered by the Minister;
  • where a national government department, the relevant provincial authority or a statutory body is
    the applicant; or
  • where the activity has the potential to affect the environment across the borders of two or more provinces.
