Introduction and background

 

The Department of Forestry, Fisheries and the Environment (DFFE) received an application for a right in terms of section 18 of the Marine Living Resources Act, 1998 [PDF] to conduct sea-based abalone ranching (of Haliotis midae) in a new area along an approximately seven (7) kilometre stretch of coastline between Doring Bay and Strandfontein Bay in the Western Cape. An area that had not previously been used for abalone ranching.

As a result, the department  published a Government Notice 704 in the Government Gazette 43474 [PDF - 473.26 kb] on 26 June 2020 to invite members of the public wishing to submit representations or comments in connection with the proposed new area. Members of the public holding interested in conducting abalone ranching in the same proposed area were invited to express interest in applying for a right to conduct ranching in that area in terms of section 18 of the Marine Living Resources Act, 1998. DFFE Minister Creecy, in the gazette, committed that; should the area be determined suitable for abalone ranching and, should other parties express an interest in applying for a right, a further notice would be published inviting formal applications to be submitted.

 

Purpose and objectives of this communication

 

The Minister of Forestry, Fisheries and the Environment, Barbara Dallas Creecy, hereby invites the public to apply for a single right in terms of section 18 of the Marine Living Resources Act, 1998 [PDF] to conduct sea-based abalone ranching (of Haliotis midae) along an approximately seven (7) kilometre stretch of coastline between Doring Bay and Strandfontein Bay in the Western Cape, as depicted on the map in the schedule hereto: Marine Living Resources Act, 1998 (Act No. 18 of 1998): Invitation to apply for a right to conduct sea-based abalone ranching in the area between Doring Bay and Strandfontein Bay in the Western Cape [G 44636 - GoN 466]. Only one (1) right to conduct ranching is available for this area.

Submissions, closing date and enquiries

 

The application process shall be done in two phases.

Phase 1 involves the submission of the application forms with the relevant documentation specified in the application form. At this phase, the application will be evaluated based on the exclusionary criteria, which was published in Government Notice No. 353 of Government Gazette 34241 dated 21 April 2011 and is linked above under the heading 'documents'. After the initial screening of applications by the department, the applicant will be informed on whether to proceed with phase two (2).

Phase 2 involves the public participation process and the submission of full proposal as outlined in the criteria and Invitation to apply for abalone ranching pilot projects, which was published in Government Notice No. 352 of Government Gazette 34241 dated 21 April 2011 and is linked above under the heading 'documents'. At this phase, the full proposal will be evaluated against the balancing criteria.

 

Any person who wishes to apply for the right to conduct the sea-based abalone ranching in the area described in this notice may submit an application on or before 28 June 2021 (one hard copy application and an electronic version on a memory stick) to the following addresses:
