Minister Molewa publishes for public comment draft regulations relating to appropriate fines

Minister of Environmental Affairs publishes for public comment in GN R 637 draft regulations relating to appropriate fines in terms of section 24g

The Minister of Environmental Affairs, Mrs Edna Molewa, has published for public comment in Government Notice R637 draft regulations relating to the procedure to be followed, and criteria to be considered, when determining an appropriate fine in terms of section 24G of the National Environmental Management Act 107 of 1998.

During the 30-day comment period, which closed on Monday 24 August 2015, a request was received from both the Centre for Environmental Rights and the Paper Manufacturers Association of South Africa that the fine calculator, with the embedded formula, be released so as to enable institutions properly to comment on the Regulations. An extension was therefore recommended.

Pursuant to this request, the Department has taken a decision to publish a link to the fine calculator with the embedded formula on the Department’s website. To get the gazetted notice, kindly follow this link  and to get the calculator and explanatory note, follow this link

In the light of this decision, interested parties are hereby provided with a further (14) fourteen day period; closing on 15 November 2015, in which to submit further comment on the draft regulations. Kindly note that late comments will not be entertained.
